RMCO: A to Z Guideline for Expatriate to Enter Malaysia 2020

This is a newly-updated guidelines for the entry of Expatriate / Skilled Worker / Knowledge Worker Entering Malaysia for Key Posts and Technical Posts, and for Dependents and Foreign Maids during the Recovery Movement Control Order (RMCO) period from 31/8/20 -31/12/20.

It does seems hard for abroad expatriate to enter Malaysia during recovery Movement Control Order (RMCO). Worry not, The Expatriate Services Division (ESD) under the Immigration Department of Malaysia has provide the guidelines for expatriate  based on certain scenarios.

Scenario 1: Expatriate with an active pass, and currently stranded abroad.

Scenario 1 is for  Expatriate with Active Pass/Exited Malaysia Before 11/6/20 and a pass holder of:

Employment Pass Category I (EP I)
Residence Pass Talent (RP-T)
Dependents
Foreign Maid for (EP I & RP-T)
Condition
Exempted to obtain Entry Approval from Director General of Immigration Malaysia (DGIM).
If expatriate possess expired pass but with a balance from the previous Expatriate Committee (EC), expatriate is required to obtain an Entry Approval Letter from DGIM. Application is via MYEntry.

Scenario 2: New Approved Pass Application for expatriate who is currently abroad.

Scenario 2 is for expatriate with pass holder of:

Employment Pass Category I (EP I)
Residence Pass Talent (RP-T)
Dependents
Foreign Maid for (EP I & RP-T)

Condition
Exempted to obtain Entry Approval from Director General of Immigration Malaysia (DGIM.
Required to obtain a visa from the respective Malaysian Embassy/ Consulate General/ High Commission (applicable for nationalities that require a visa to enter Malaysia).
For new application, company is required to submit the application through the relevant Approving Agency for Approval Letter.

Process Flow For Entering Malaysia

Scenario 3: Expatriate / Skilled Worker /Knowledge Worker with an Active Pass / Exited Malaysia During Movement Control Order (RMCO), who is currently stranded abroad.

Scenario 3 is for expatriate with pass holder of:

Employment Pass Category (EP II/III)
Professional Visit Pass (PVP)
Dependents
Foreign Maids for (EP II/III)
Long Term Social Visit Pass (LT-SVP) for (RP-T, EP 1/II /III)

Condition
Application for entry permission has to be submitted by the company, together with a Support Letter from the Approving Agency.
The application is submitted via MYEntry to obtain the decision of the Director General ofImmigration Department Malaysia (DGIM).
Support Letter for DEPENDANTS / LT-SVP / FOREIGN MAIDS is not required.
Approval by the DGIM is FOURTEEN (14) working days from the date of the application submission. All applications that did not receive any response after FOURTEEN (14) working days will be considered as rejected.
Entry permission for the applicant that can be approved are KEY POST and TECHNICAL positions that have been assessed by the Approving Agency.
Upon approval by the DGIM, (ESD) will issue an Entry Approval Letter for the applicant to the company, with copies sent to the Approving Agency or Regulatory Body, National Disaster Management Agency (NADMA), National Security Council (NSC), Malaysian Missions Abroad, Foreign Missions and related agencies.
The company is responsible for sending and/or e-mailing the Entry Approval Letter to the expatriate.
The expatriate who is currently abroad with an expired pass is required to obtain a visa from the respective Malaysian Embassy / Consulate General / High Commission prior to entering Malaysia (only applicable for nationalities that require a visa to enter Malaysia).

Scenario 4: New Approved Pass Application for Expatriate /Skilled Worker /Knowledge Worker who is currently abroad.

Scenario 4 is for expatriate with pass holder of:

Employment Pass Category (EP II/III)
Professional Visit Pass (PVP)
Dependents
Foreign Maids for (EP II/III)
Long Term Social Visit Pass (LT-SVP) for (,RP-T, EP I/II /III)

Condition
The company submitted the expatriate’s application through the Approving Agency and the new position application will be processed by their respective Expatriate Committee (EC).

Scenario 5: New Approved Pass Application for Expatriate /Skilled Worker / Knowledge Worker by non registered ESD online Approving Agencies (e.g: Public Institutions of Higher Learning (IPTA), MIDA /IRDA approval).

Scenario 5 is for expatriate with pass holder of:

Employment Pass Category (EP I/ II/III)
Professional Visit Pass (PVP)
Dependents
Foreign Maids for (EP I/II/III)
Long Term Social Visit Pass (LT-SVP) for (EP I/II /III)

Guideline:

  1. For Approval with Employment Pass Category (EP I),  follow the guideline on Scenario No. (2): NEW APPROVED PASS APPLICATION for expatriate who is currently abroad.
  2. For Approval with Employment Pass Category (EP II & EP III),  follow the guideline on Scenario No. (4): NEW APPROVED PASS APPLICATION for expatriate who is currently abroad.
  3. The company is RESPONSIBLE  for sending and / or e-mailing the Company Offer Letter and Acknowledgement Letter (AP) issued by the Immigration Department of Malaysia to the applicant for the purpose of entry to Malaysia

  1. The expatriate is required to comply with the rules and regulations set by the Immigration Department of Malaysia.

  4. The above procedures are for references purposes for now. There may be changes of procedures by the Ministry of Health, Malaysia or Immigration Department, Malaysia along the way.
